What’s the difference?

Mediators are neutral parties brought in to a dispute to assist the parties in reaching a settlement agreement through means of negotiations between the parties.

Arbitrators are licensed bar members of the state and are also neutral parties. The role of an arbitrator is similar to that of a bench trial Judge, albeit in a less formal setting. Both parties will present the facts of the case and any evidence just as they would at trial; however, instead of the parties reaching negotiations the Arbitrator will be the decision maker. Then the Arbitrator’s report is presented to the Judge for final review.

WHICH one IS RIGHT FOR THIS ISSUE?

Mediation might be the best choice if the parties to the matter are able and willing to negotiate to reach a conclusion. Matters such as personal injury, general civil, and most contract disputes, are just a few types of cases that are suitable for mediation.

Arbitration services are better suited for cases where the parties are not willing to negotiate and may have reached an impasse on what each is willing to offer further. Arbitration is also helpful when the case may be ready for a bench trial but the next available trial date is too far in the future. This could aid reaching a resolution much sooner.
